A white, reserve sheriff's deputy was charged Monday in Oklahoma with manslaughter in the death of an unarmed black suspect whose shooting while on the ground at officer's feet was captured on videotape.
Second-degree manslaughter charges were filed against reserve deputy Robert Charles "Bob" Bates, 73, in the shooting death of Eric Courtney Harris, 44, District Attorney Stephen Kunzweiler's office in Tulsa said.

"Mr. Bates is charged with Second-Degree Manslaughter involving culpable negligence. Oklahoma law defines culpable negligence as 'the omission to do something which a reasonably careful person would do, or the lack of the usual ordinary care and caution in the performance of an act usually and ordinarily exercised by a person under similar circumstances and conditions,'" Kunzweiler said in a statement.
The release of the dramatic video has fueled controversy surrounding the shooting of an unarmed suspect who was already on the ground. It follows a public outcry over a series of cases around the country in which unarmed black men died at the hands of police in places including Ferguson, Mo., North Charleston, S.C., and New York City.
Bates has been a reserve deputy since 2008 and was assigned to the sheriff's Violent Crimes Task Force, the district attorney said.
Earlier in the day, Tulsa County Sheriff Stanley Glanz described Bates as a longtime friend who made "an error" last week when he fatally shot an unarmed man trying to flee deputies during an undercover operation to retrieve stolen guns, the Tulsa World reported. The newspaper said Bates had donated thousands of dollars in equipment to the sheriff's department since signing on in 2008 as an unpaid reserve deputy.

"He made an error," Glanz said. "How many errors are made in an operating room every week?"

Bates says he meant to shoot the suspect with a stun gun during the confrontation April 2 but accidentally drew and fired his .38-caliber handgun.
The video shows Harris running away from officers pursuing him on foot. Harris is caught and put to the ground, where a struggle ensues.
Bates arrives at the scene and a single gunshot is heard, then, "Oh, I'm sorry. I shot him." Harris is heard screaming "He shot me. Oh my God!" adding that he is having trouble breathing. A deputy responds "(Expletive) your breath."
Sheriff's Maj. Shannon Clark told the World that Bates donates his time and is a highly regarded member of the Reserve Deputy Program. He has also donated multiple vehicles, guns and stun guns, Clark said.

"There are lots of wealthy people in the reserve program," he said. "Many of them make donations of items. That's not unusual at all."
The department website says "dedicated reserve deputies work full time jobs in the community and volunteer their time in a myriad of events such as the Special Olympics and Tulsa State Fair."
Bates, an insurance executive, is classified as an "advanced reserve" and can do anything a full-time deputy can do, Clark told the World. In fact, Bates was assigned to the sheriff's Violent Crimes Task Force.
The video of the shooting was released at the request of the Harris family.
Tulsa police Sgt. Jim Clark, who investigated the case, on Friday determined that the shooting was not a crime and did not violate department policy.
"Reserve Deputy Bates did not commit a crime," he said. "There's no other determination I could come to."
Clark cited "slip and capture," a psychological phenomenon where, under stress, someone's behavior "slips" off the intended path after being "captured" by a stronger response demanded by the brain.
Clark determined that Bates was a "victim" of the phenomenon.
Dan Smolen, lawyer for the Harris family, told the Tulsa World that Clark's ruling was "premature and ill-advised."
Smolen has also challenged a Tulsa Fire Department report that Harris was "uncooperative and combative" as firefighters attempted to assess and treat his wound.
Smolen said Harris could hardly be combative since he was struggling with labored breathing and his hands were cuffed.
"It's most likely the word combative is being used because that's what they're being told by the Sheriff's Office," Smolen told the World. "The other alternative is their use of the word combative is more a description of Mr. Harris struggling to get air and kind of writhing in pain from the gunshot wound."

Reserve deputy who shot, killed man thought he drew his Taser, release says
A sheriff’s release recounts the fatal shooting of a suspect.






Bates confirmed in a phone interview with a Tulsa World reporter Friday that he shot and killed Eric Courtney Harris the previous day.
“It was me,” Bates said during the interview. “My attorney has advised me not to comment. As much as I would like to, I can’t.”
The Sheriff’s Office on Friday evening released Bates’ name and said he received his reserve status in September 2008.
The release states that Bates was assigned to the Tulsa County Violent Crimes Task Force and had received specialized training in homicide investigation, meth lab identification and decontamination, and other specialized training.


Bates, according to the release, saw Harris reach near his waistband as he fled from pursuing deputies and responded by pulling out what he thought was a Taser. After Harris became involved in a struggle with another deputy, Bates, thinking he was using a Taser, fired one shot, striking Harris.
“During the rapidly evolving altercation, the reserve deputy had what he believed was his Taser ... when he inadvertently discharged his service weapon, firing one round which struck Harris,” according to the media release issued by the Sheriff’s Office.
Harris was treated at the scene by EMSA and died less than an hour later at a Tulsa hospital, according to Clark.
Clark said “preliminary information” has led investigators to believe Harris was under the influence of PCP at the time of the shooting.
Tulsa Police Department homicide Sgt. Dave Walker said Friday that although the homicide took place in the city limits, TPD would not investigate the death unless the Sheriff’s Office asked them to.
“And they have not asked us to,” Walker said.
Bates was named Reserve Deputy of the Year in 2011, according to the Sheriff’s Office website.
Clark said Thursday that it’s not unusual for a reserve deputy to be on an assignment such as the Violent Crimes Task Force.
“What I will say is that the deputy had the specialty training to be assigned to this task force, similar to what a full-time deputy would have had,” Clark said Thursday.
Clark said the Sheriff’s Office has more than 100 reserve deputies, all of whom go through the same training components as a normal deputy but with an abbreviated curriculum.
Reserve deputies “have full powers and authority” of a deputy while on duty, he said.
At 10:30 a.m. Thursday, attorneys for Bates were in Tulsa County District Court for a hearing in a civil lawsuit in which he is the defendant, records show. The pre-trial hearing was held in District Judge Jefferson Sellers’ courtroom, with attorney Clark Brewster and two other attorneys representing Bates, records show.
Bates is being sued by his former insurance agency, Robert C. Bates LLC, in Tulsa County District Court.
He formed Robert C. Bates Inc. in 1977 and sold the agency in 1999. Bates remained as head of the new company, Robert C. Bates LLC, until resigning in 2012, records show.

He now operates Commercial Insurance Brokers LLC, at 4200 E. Skelly Drive, records show.
