PARIS — When Otto Frank first published his daughter’s red-checked diary and notebooks, he wrote a prologue assuring readers that the book mostly contained her words, written while hiding from the Nazis in a secret annex of a factory in Amsterdam.
But now the Swiss foundation that holds the copyright to “The Diary of Anne Frank” is alerting publishers that her father is not only the editor but also legally the co-author of the celebrated book.
The move has a practical effect: It extends the copyright from Jan. 1, when it is set to expire in most of Europe, to the end of 2050. Copyrights in Europe generally end 70 years after an author’s death. Anne Frank died 70 years ago at Bergen-Belsen, a concentration camp, and Otto Frank died in 1980. Extending the copyright would block others from being able to publish the book without paying royalties or receiving permission.

In the United States, the diary’s copyright will still end in 2047, 95 years after the first publication of the book in 1952.

While the foundation, the Anne Frank Fonds, in Basel, signaled its intentions a year ago, warnings about the change have provoked a furor as the deadline approaches. Some people opposed to the move have declared that they would defy the foundation and publish portions of her text.
Foundation officials “should think very carefully about the consequences,” said Agnès Tricoire, a lawyer in Paris who specializes in intellectual property rights in France, where critics have been the most vociferous and are organizing a challenge. “If you follow their arguments, it means that they have lied for years about the fact that it was only written by Anne Frank.”
The decision has also set the foundation on a possible collision course with the Anne Frank House museum in Amsterdam, a separate entity that for years has sparred with the Anne Frank foundation over legal questions, such as ownership of archives and trademark issues.
The museum has been working for five years with historians and researchers on an elaborate web version of the diary intended for publication once the copyright expires. The research is still progressing with a historical and textual analysis of her writing, including deletions, corrections and stains.
“We haven’t decided yet when or how the results will be published,” said Maatje Mostart, a spokeswoman for the Anne Frank House. “Any publishing will always be done within the legal frameworks.” She added pointedly that neither “Otto Frank nor any other person is co-author.”
One of Anne’s own astute diary entries seemed to anticipate the disputes: “Why do grown-ups quarrel so easily?”
Anne was 15 when she died at Bergen-Belsen. She had been arrested after someone alerted the authorities that the family had been hiding in the secret annex of a pectin factory on the Prinsengracht, or Prince’s Canal. Otto Frank was the family’s only survivor.
After arranging for her diary and notebooks to be published, he tried to secure Anne’s legacy. In 1960, he and the City of Amsterdam helped save the building where the family had hidden. (It became the Anne Frank House.)
Three years later, he set up the foundation in Switzerland to collect the diary’s royalties and distribute them to charities such as Unicef, children’s education projects and a medical fund that today supports about 50 gentiles who saved Jews during the war. He left her actual diaries and notebooks to the Dutch state.
“Effectively, Otto split up the legacy of his daughter, which one could say has created a bit of a nice mess ever since,” said Gerben Zaagsma, a historian of modern Jewish history at the University of Göttingen in Germany who is working on a scholarly edition of the diary backed by the foundation and Germany’s culture ministry.
The foundation does not publish yearly reports about its finances. But in recent years, it said it had donated about $1.5 million annually to hundreds of charitable organizations.
“The longer they can claim copyright protection, the longer they can ask money for publication of the works,” said Stef van Gompel, a professor at the University of Amsterdam who specializes in copyright law.
Six years ago, the foundation asked legal experts in various countries for advice on its copyright, according to Yves Kugelmann, a member of the foundation’s board. They concluded, he said, that Otto “created a new work” because of his role of editing, merging and trimming entries from her diary and notebooks and reshaping them into “kind of a collage” meriting its own copyright.
Merely declaring Otto the “co-author” on copyright filings extends the copyright, legal experts said, though such a stand could be tested in the courts. Readers would not see any changes on the books themselves, foundation officials said.
The foundation’s officials said that their aim is to “make sure that Anne Frank stays Anne,” Mr. Kugelmann said, by maintaining control and avoiding inappropriate exploitation of the work. “When she died, she was a young girl who was not even 16. We are protecting her. That is our task.”
Critics, he said, are wrongly looking at the intended change as a financial matter. “It is not about the money,” he said.
But Mr. van Gompel, the copyright lawyer, said extending the copyright runs counter to the intention of the laws.
“There is a good reason that copyrights are limited, so that people can freely use” written materials, he said. “It doesn’t mean that they need to be protected for all eternity.”
Copyright protections vary from country to country. The classic novella “The Little Prince” fell into the public domain this year in much of the world but remains under copyright in France because of an exception that grants a 30-year extension to authors who died during military service in World War I and II.
Some critics of the foundation have already tested its resolve by posting bootleg copies of the diary online.
Olivier Ertzscheid, a lecturer in communications and researcher at the University of Nantes, received a warning letter this month from a French publisher of the diary after he started circulating a copy online in protest. He removed it, but he and a French politician, Isabelle Attard, said they were waiting to see what happens in January before pressing forward with a plan to encourage publication of the original manuscript more widely online.
“The best protection of the work is to bring it in the public domain, because its audience will grow even more,” said Ms. Attard, who noted that her own Jewish relatives were hidden or deported during the German occupation in France. “What is happening now is a bluff and pure intimidation.”
The foundation insists that by issuing an early warning of its intent to extend the copyright, it is acting ethically to prevent publishers from pursuing a course that might be unproductive and costly.
But if the foundation succeeds, publishers may wind up waiting even longer than the 70 years allowed after Otto Frank’s death.
A second editor, Mirjam Pressler, revised, edited and added 25 percent more material from Anne Frank’s diary for what was called a “definitive edition” in 1991. She qualified for a copyright for her creative work, and the rights were transferred to the foundation, said its lawyer, Kamiel Koelman.
She is still living, he added, giving them copyright ownership from the date of her future death for at least another 70 years.

Who wrote Diary of Anne Frank?

http://lovkap.blogspot.com/2011/01/who-wrote-diary-of-anne-frank.html

                       THE FREEMEN
Dear Brethren,

IS "DIARY OF ANNE FRANK" A FRAUD?

Lies being taught;

Anne Frank was victim of Holocaust who was a brave girl and kept a diary of her ordeal during Holocaust which narrates horrors of Holocaust.
Now the truth;

Textbook History has myths that live a longer and richer life than truth. A New York Court awarded $50,000 to an American novelist Meyer Levin, to be paid By Otto Frank the father of Anne Frank as an honorarium for Levin's novel "Diary of a Young Girl" also known as "Diary of Anne Frank". Mr. Otto Frank, had promised to pay to a Jewish novelist Meyer Levin not less than $50,000 because he had used the literary creation of author Levin  in toto, and represented it to his publisher and the public as his late daughter’s original work.

Otto Frank later decided on a Broadway production of the same novel but did not pay Meyer Levin for use of his novel for Broadway production whcih was against the terms of contract. hence Meyer Levin sued Otto Frank for his writings, and the New York Court Jury awarded Meyer Levin $50,000, for his 'intellectual work'.

The Jury awarded $ 50,000 dollars as compensation to be paid by Otto Frank father of Anne Frank to Jew novelist Meyer Levin who wrote Diary of Anne Frank. That award was later set aside by the trial justice, Hon. Samuel C. Coleman, on the ground that the damages had not been proved in the manner required by law as it was not based upon "legal" evidence of loss. The reason was that if Writer Meyer levin had written the said novel under his own name and sold it as it was a fiction, then it would not have sold so many copies. Because Otto Frank father of Anne frank gave this fictional novel name of his dead daughter and projected to gullible public as “real” story of Anne Frank that so many copies were sold and windfall profits were made. However in further appeal against the order of Judge Coleman, by Jewish novelist Meyer Levin matter was compromised out of court between the parties.
Jewish writer Meyer Levin had approached the Court for his claim for damages on account of writing the “Diary of Anne Frank”, He had also won his case from the Jury, He would not have withdrawn his Appeal had he not been paid out of court by Otto Frank, to avoid media publicity. So Otto Frank did pay Jewish writer Meyer Levin $ 50,000 dollars or thereabout for writing ‘Diary of Anne Frank’.
Complete details of the case are available in case titled Meyer Levin Vs Otto Frank, File number 2241-1956 in the New York County Clerk’s office.

In 1980, Otto Frank sued two Germans, Ernst Romer and Edgar Geiss, for distributing literature denouncing the diary as a forgery. The trial produced a study by official German state forensic bureau, the Bundes Kriminal Amt [BKA] forensically examined the manuscript, which at that point in time consisted of three hardbound notebooks and 324 loose pages bound in a fourth notebook, with special forensic equipment. In the end, BKA clearly determined that none of the diary handwriting matched known examples of Anne's handwriting. The bureau determined that everything in the diary was written by the same person. The person that wrote the diaries had used a ballpoint pen throughout. Unfortunately for Herr Frank, the ballpoint pen was not available until 1951 whereas Anne was known to have died of typhus in 1944.
The German magazine, Der Spiegel, published an account of this report stating that;-
(a) some editing postdated 1951;
(b) Experts had held that all the writing in the journal was by the same hand; and thus –
(c) the entire diary was a postwar fake.

The diary of Anne frank is written in Ball point pen. Ball point pen was invented by László Bíró, in 1938. In 1940 the Bíró brothers and a friend, Juan Jorge Meyne, moved to Argentina fleeing Nazi Germany and on June 10 filed for its patent. however it never came into production till about 29 October 1945 in America and was not readily available to all till 1951. Children were not even allowed to use Ball point pen till several years later as it destroyed their hand writing.

Millions of humans world wide were fed a fiction by Jew Otto Frank for the sake of money is nothing new. In any case it was not the fault of Anne Frank. She had not done anything wrong. She had not even written any diary.

Note by author;-
What everybody believes in, is that Jewish Writer Meyer Levin had impersonated Anne frank, the extent of impersonation is in doubt whether it was ‘X’ % or ‘Y’%. To my mind if impersonation is accepted then whether it is in part or in whole is immaterial. Even those who believe that Anne Frank wrote part of diary also believe that her father tore off part of her diary which was favorable to Nazi regime and unfavorable to her own family particularly  unfavorable to her own father Otto Frank. So whether it is a case of half truth or full lies, the diary has to be denounced as fake.
Secondly If Meyer Levin had not written the first part someone who was “paid well” might have, receipt properly taken and no cause for a court case !!!
Thirdly where is the case for profits, such instances come dime a dozen in:-
a)     All 70 + Countries attacked and enslaved for world domination British  where every household suffered similar fate in the hands of their British masters.
b)     Treatment of slaves in America or treatment of US native inhabitants by European immigrants or Jews who are ruling US today.
c)     Treatment of slaves by Europeans. The bible mentions that the Jews went into slavery. Deuteronomy 28:68 and they had yokes of iron put around their necks. Deuteronomy 28:48
d)     Every place which has suffered slavery has worst diaries, except that in those countries slaves do not own the media.
Lastly in some countries denial of holocaust / or Anne frank diary is illegal. In some cities particularly in Amsterdam such diaries have been used to generate massive tourism and made a source of revenue. Such cities / countries or their “courts of law” will jealously defend the diary and will prosecute to the extent of bankruptcy anyone and everyone who publicly denies the diary as a fraud. However such prosecution has nothing to do with upholding the truth but more to protect the revenue illegally earned over last fifty five years. A case in hand is that of David Irwing. Another is Julian Assange, who has been persecuted for publishing truth in Wikileaks. Nobody has challenged the truth in Wikileaks yet Julian Assange has been persecuted to the extent of bankruptcy.
Freedom can mean freedom of expression or freedom to sway the masses by the money power of political donations, or having your own chosen one as a puppet President 'who' then decides on judges most of whom dance to moneyers behind their appointments.

It may be a story to gather search hits away from that lawsuit and the real history.  Kind of like the idiot jew dancing in new York which was an intentional operation to draw searchers of "dancing Israelis" away from the 911 topic.

“We asked them to get out of the van, but they didn’t listen,” he said. “So, we . . . put them in handcuffs and did it as quickly as possible.”
AFP asked DeCarlo why he thought the Israelis refused to follow his orders. DeCarlo was unsure, but asked this writer, “You ever have a gun pointed at your head?”
DeCarlo then described what happened after the spies were dragged from their van. “When we removed them, one of the guys that was rather chatty said: ‘We’re not your enemy, we’re your friend. Our enemies are your enemies,’” DeCarlo said. “At that point they said they were from Israel. They kept saying, ‘Hey, we’re on your side.’”
“We brought them over to the New Jersey State Police holding cells in the Meadowlands Stadium, and that’s the last I saw of them,” he said. Shortly after that, the Federal Bureau of Investigation reportedly took over. The five Israelis were held for 10 weeks, but were eventually deported to Israel on charges of immigration violations. In November 2001, they appeared on an Israeli TV talk show discussing how they were in the U.S. “to document the event.”

Bogus Israeli Moving Co -
Israeli Intel - Back In US?
By Wayne Madsen
9-14-5

Is Urban Moving Systems chief back in US? There are indications that Israeli national Dominik Suter, the former head of Urban Moving Systems in Weehawken, NJ is back in the United States, this time in south Florida and may be using his actual name. Suter ran the Weehawken, NJ-based moving company on 9-11 when a number of Urban Moving Systems vans were spotted around north Jersey before and after the hijacked planes struck the World Trade Center. One Urban Moving van was seen at Liberty State Park in Jersey City as the first plane hit the towers. The five occupants, all Israeli nationals, were seen videotaping and celebrating the attack and were dressed in Arab clothing. The five were later arrested near Giant Stadium in East Rutherford, NJ. One of the Israelis told police they were at Liberty State Park to "document the event."

After the Israelis were detained for several months in Brooklyn as terrorist suspects, they were quickly deported to Israel. After the FBI questioned Suter on September 11, he fled the United States on September 14, 2001. The FBI was due to question Suter again before he fled the country. Later, Federal law enforcement agents discovered pipes, caps, explosive chemical materials, and traces of anthrax at the Weehawken warehouse. Suter's name and those of some of his moving employees turned up in a CIA database of foreign intelligence agents. Suter's name also appeared on an FBI 9-11 terrorism suspect list. Suter's year of birth is listed as 1970 with a social security number of 129-78-0926. His addresses before 9-11 are listed as 28 Harlow Crescent Rd., Fairlawn, NJ 07410; 312 Pavonia Ave., Jersey City, NJ 07302; and 15000 Dickens, Suite 11, Sherman Oaks CA. If Suter has been permitted to re-enter the United States, the FBI and the Department of Homeland Security and its chief Michael Chertoff have a lot of explaining to do.
